- Scope & content
- Judgment: regarding charges of hunting with a gill net without a license in the Township of North Algona contrary to section 71 (1) of the Ontario Garoe and Fish Act. Thirty-two page judgment which examines historical material (concerning the claims of the Algonquin Indians to their hunting grounds in the Ottawa Valley) to facilitate the interpretation of section 88 of the Indian Act. Cites many cases of similar charges against Indians in Ontario and other parts of Canada. Finds that the Algonquins have not entered into any treaty (particular reference to the Williams Treaties of 1923) or performed any other act of cession or surrender with respect to their aboriginal rights and that they have a substantial claim to aboriginal hunting and fishing rights in Renfrew County and adjacent lands. Dismisses charges against the defendant.
